Terms of Service

Last updated: April 2025. These terms govern your use of the Beholdr personal financial tracking service, operated under the laws of New South Wales, Australia.

1. About these terms

These Terms of Service ("Terms") govern your access to and use of Beholdr, operated by Blair Singleton (ABN pending), based in New South Wales, Australia ("we", "us", "our").

By creating an account or using Beholdr, you agree to these Terms. If you do not agree, do not use the service. These Terms form a binding agreement between you and us under the laws of New South Wales, Australia.

2. What Beholdr is (and is not)

Beholdr is a personal financial tracking tool. It helps you categorise your spending, set budgets, and understand your financial position by importing transaction data from your bank's CSV export.

Beholdr is NOT financial advice. Nothing in the app — including budget suggestions, spending summaries, safe-to-spend calculations, projections, or any other output — constitutes financial product advice within the meaning of the Corporations Act 2001 (Cth). All financial decisions are your own.

Beholdr is also NOT a banking service, a credit provider, an investment platform, or a financial institution. It does not hold your money, process payments, or access your bank accounts.

3. Your account

To use Beholdr, you must create an account using a valid email address. You must:

• Be at least 18 years of age (or the age of majority in your jurisdiction). • Provide accurate information during registration and keep it current. • Maintain the security of your password and take responsibility for all activity under your account. • Notify us promptly at support@beholdr.au if you suspect unauthorised access to your account.

You may not create more than one account per person, share your account with others, or use another person's account without their authorisation.

4. Acceptable use

You agree to use Beholdr only for lawful, personal financial tracking purposes. You must not:

• Attempt to access, query, or modify another user's data. • Reverse-engineer, decompile, or attempt to extract the source code of the service. • Use automated tools, scrapers, or bots to interact with the service. • Upload CSV files containing data that does not belong to you or that you are not authorised to process. • Use the service in a manner that violates any applicable Australian law or regulation. • Attempt to circumvent security controls, authentication systems, or access restrictions.

We reserve the right to suspend or terminate your account if you breach these terms.

5. Free and paid tiers

Beholdr offers a free tier and a paid subscription tier ("Beholdr Plus").

Free tier: Access to core tracking features, budgets, Plan Ahead, Reports, Dashboard, Accounts, and CSV import with categorisation. Limited to the last 6 months of transaction history. No credit card required. Free forever.

Beholdr Plus: Access to full unlimited transaction history, AI assistant, advanced insights, recurring detection, goals and savings targets, push notifications, PDF export, and priority support. Billed monthly or annually at the current published rate.

Billing: Plus subscriptions are billed in advance through our payment provider (Stripe). By subscribing, you authorise us to charge your payment method on a recurring basis. You can cancel at any time; your access continues until the end of the current billing period.

Refunds: Subject to your rights under the Australian Consumer Law, subscription fees are generally non-refundable. If you believe you have been incorrectly charged, contact support@beholdr.au within 30 days.

6. Your data

Your financial data belongs to you. We do not sell it, share it with advertisers, or use it to build profiles for purposes outside of providing the Beholdr service.

You retain all rights to the transaction data you import. By using the service, you grant us a limited licence to store, process, and display your data for the purpose of providing the service to you.

How we handle your data is described in detail in our Privacy Policy, which forms part of these Terms.

7. Account deletion and data retention

You may delete your account at any time via Settings → Delete account. When you delete your account:

• All your personal data — transactions, accounts, budgets, rules, bills, settings, and your user record — is permanently and irreversibly deleted in a single operation. • Nothing is archived, retained, or recoverable after deletion. • If you have an active Plus subscription, deleting your account also cancels the subscription. No partial-period refund is issued unless required by the Australian Consumer Law.

We may retain anonymised, aggregated data that cannot identify you (e.g. aggregate usage statistics) after your account is deleted.

8. Availability and changes to the service

We aim to keep Beholdr available at all times but do not guarantee uninterrupted access. We may:

• Perform maintenance that temporarily interrupts the service (we will endeavour to provide advance notice). • Add, modify, or remove features at any time. • Discontinue the service entirely, with reasonable notice provided to your registered email address.

If we make material changes to these Terms, we will notify you by email or in-app notice at least 14 days before the changes take effect. Continued use of the service after that date constitutes acceptance of the updated Terms.

9. Intellectual property

The Beholdr name, logo, design, software, and all content we create (excluding your data) are our intellectual property or are used under licence. You may not reproduce, distribute, or create derivative works without our prior written consent.

The category taxonomy, categorisation rules, and machine-learned patterns within the service are our proprietary work. Nothing in these Terms transfers ownership of any intellectual property to you.

10. Limitation of liability

To the maximum extent permitted by law, we are not liable for:

• Financial decisions you make based on information shown in Beholdr. • Errors or omissions in categorisation, budget suggestions, projections, or any other calculated output. • Loss of data arising from circumstances beyond our reasonable control. • Indirect, consequential, incidental, or special damages of any kind.

Nothing in these Terms excludes any guarantee, condition, or warranty implied by the Australian Consumer Law (ACL) that cannot lawfully be excluded. Where the ACL applies, our liability for any failure to comply with a consumer guarantee is limited, to the extent permitted by law, to resupplying the service or paying the cost of resupply.

11. Indemnity

You agree to indemnify and hold us harmless from any claims, losses, or damages (including reasonable legal costs) arising from your use of the service in breach of these Terms, your violation of any law, or your infringement of any third-party rights.

12. Governing law

These Terms are governed by the laws of New South Wales, Australia. Any dispute arising under or in connection with these Terms is subject to the exclusive jurisdiction of the courts of New South Wales, Australia.
